Marriage signifies a profound and intimate bond between two people. To ensure a strong and fruitful marriage, it is important to know how assets and liabilities in the marriage will be dealt with. This knowledge minimises the potential for unnecessary conflict in the marriage and allows spouses to fully and truly enjoy their union to the fullest.
1. MARRIAGE IN COMMUNITY OF PROPERTY
Attributes
- Total sharing of all assets and liabilities
- No separate estates. All assets and liabilities form part of one joint estate
- Parties each possess 50% undivided share of all assets and liabilities
- Limited right of parties to transact on behalf of the joint estate
- Upon divorce joint estate usually divided equally
2. MARRIAGE OUT OF COMMUNITY OF PROPERTY EXCLUDING ACCRUAL
Attributes
- No sharing of assets and liabilities whatsoever
- Totally separate estates.
- Parties each possess 100& share in their own assets and liabilities
- Unlimited right of parties to transact on their own behalf
- No division of assets upon divorce
2.1 MARRIAGE OUT OF COMMUNITY OF PROPERTY INCLUDING ACCRUAL
Attributes
- No sharing of assets and liabilities whatsoever
- Totally separate estates.
- Parties each possess 100& share in their own assets and liabilities
- Unlimited right of parties to transact on their own behalf, subject to Matrimonial Property Act
- Division of the accrual at divorce
MARRIAGE OUT OF COMMUNITY OF PROPERTY INCLUDING ACCRUAL
Excluded Assets
Excluded assets are assets which are not taken into account
when calculating the accrual.
In other words, the value of the asset will be omitted in
totality when calculating the accrual, both in respect of
commencement value and end value
